Overview

Khajaque is a highly regarded intellectual property litigator with over 32 years’ experience advising local and international clients on complex contentious and advisory IP matters, covering trade mark and brand enforcement as well as patent, designs, copyright and related Australian Consumer Law enforcement.

Khajaque regularly represents clients in the Federal Court of Australia in relation to intellectual property litigation including trade marks, patents, designs, copyright, confidential information and related Australian Consumer Law claims.   Khajaque has also represented client’s in key Full Federal Court Appeals as well as High Court of Australia appeals.  He regularly appears in proceedings before the Trade Marks Office. He is widely recognised for his strategic approach to enforcement and appellate litigation and alternative conflict resolution, including guiding clients through high‑stakes brand disputes as well as for working with clients for effective anti-counterfeiting strategies.

His practice also encompasses IP issues arising in the digital and online environment, and he is noted for a strong track record in domain name dispute resolution. Khajaque’s work reflects a consistent focus on protecting and enforcing IP rights including brand rights in technically complex and commercially sensitive contexts.

Khajaque is a member of the Institute of Patent and Trade Mark Attorneys of Australia and a member of the Intellectual Property Society of Australia and New Zealand. He is also a member of the International Trade Marks Association (INTA)  and has served on INTA’s Anti-Counterfeiting & Enforcement Committee (East Asia & Pacific Subcommittee). Khajaque has presented many papers on IP law and practice at various legal conferences and seminars.
